Terms and Conditions — ReQuant SMS Messaging Program

These Terms and Conditions govern your participation in the ReQuant SMS Messaging Program (“the Program”) operated by Visyfy, LLC (“ReQuant,” “we,” “us”). By opting in, you agree to these terms.

Program Description

The ReQuant SMS Program delivers transactional, promotional, and conversational messages from ReQuant — our on-premises agentic CRM appliance — to mobile phone numbers that have opted in. Messages are sent on behalf of the business operating the appliance and may include account notifications, appointment and reservation reminders, customer support replies, AI-generated conversational responses, and promotional messages such as loyalty offers, event invitations, and giveaways. SMS delivery is provided through Twilio.

How to Opt In

Consent is collected in one of two ways depending on who you are:

– Customers of a business that uses the ReQuant appliance opt in directly with that business — for example, by joining the business’s loyalty or membership program, completing a sign-up form at one of its locations, or providing express consent that the business confirms through a double opt-in text. ReQuant does not source, purchase, rent, or collect customer contact lists.
– Employees and operators of a business that uses the appliance opt in to receive operational and conversational messages when they are onboarded and provisioned to use the system.

By opting in, you confirm that you are the subscriber or authorized user of the mobile number provided and that you consent to receive automated SMS messages.

Message Frequency

Message frequency varies based on your interaction with the business operating the appliance. You may receive anywhere from a few messages per month to multiple messages per day depending on the conversation.

Message and Data Rates

Message and data rates may apply. ReQuant does not charge a fee for SMS messages, but standard carrier message and data rates from your mobile provider apply. Contact your mobile carrier for details on your plan.

Opt-Out Instructions

You may opt out of the Program at any time. Reply STOP to any message to unsubscribe — you may also simply tell the agent in plain language (for example, “stop texting me”) and the system will honor it. After you opt out, you will receive one final confirmation message and no further messages from the Program.

To rejoin the Program after opting out, opt in again using one of the methods above.

Supported Carriers

The Program is supported on all major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.

Eligibility

You must be at least 21 years old to participate in the Program. By opting in, you represent that you meet this requirement.

Privacy

Your use of the Program is also governed by our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in consent will never be shared with any third parties.

Disclaimer of Warranties

The Program is provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, regarding message delivery, content accuracy, or uninterrupted operation. AI-generated responses may contain errors and should not be relied on as professional advice.

Limitation of Liability

To the maximum extent permitted by law, Visyfy, LLC shall not be liable for any indirect, incidental, consequential, or special damages arising from your participation in the Program, including delayed or undelivered messages or charges from your mobile carrier.

Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued participation after changes are posted constitutes acceptance of the updated terms.
