Terms and Conditions

These Terms and Conditions govern your participation in the ReQuant SMS Messaging Program ("the Program") operated by Visyfy, LLC ("ReQuant," "we," "us"). By opting in, you agree to these terms.

Program Description

The ReQuant SMS Program delivers transactional, promotional, and conversational messages from ReQuant, our on-premises agentic CRM appliance, to mobile phone numbers that have opted in. Messages are sent on behalf of the business operating the appliance and may include account notifications, appointment and reservation reminders, customer support replies, AI-generated conversational responses, and promotional messages such as loyalty offers, event invitations, and giveaways. SMS delivery is provided through Twilio.

How to Opt In

Consent is collected in one of two ways depending on who you are:

• Customers of a business that uses the ReQuant appliance opt in directly with that business, for example by joining the business's loyalty or membership program, completing a sign-up form at one of its locations, or providing express consent that the business confirms through a double opt-in text. ReQuant does not source, purchase, rent, or collect customer contact lists.
• Employees and operators of a business that uses the appliance opt in to receive operational and conversational messages when they are onboarded and provisioned to use the system.

By opting in, you confirm that you are the subscriber or authorized user of the mobile number provided and that you consent to receive automated SMS messages.

Message Frequency

Message frequency varies based on your interaction with the business operating the appliance. You may receive anywhere from a few messages per month to multiple messages per day depending on the conversation.

Message and Data Rates

Message and data rates may apply. ReQuant does not charge a fee for SMS messages, but standard carrier message and data rates from your mobile provider apply. Contact your mobile carrier for details on your plan.

Opt-Out Instructions

You may opt out of the Program at any time. Reply STOP to any message to unsubscribe. You may also communicate your preference in natural language (for example, "stop texting me"), and the system will process it accordingly. After opting out, you will receive one final confirmation and no additional messages.

To rejoin after opting out, use the same consent methods described above.

Supported Carriers

The Program is supported on all major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.

Eligibility

You must be at least 21 years old to participate in the Program. By opting in, you confirm meeting this requirement.

Privacy

Your participation is governed by our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing purposes. SMS consent data remains confidential.

Disclaimer of Warranties

The Program is provided on an "as-is" and "as-available" basis. No warranties apply regarding delivery, accuracy, or continuous operation. AI-generated responses may contain errors and should not substitute professional guidance.

Limitation of Liability

To the maximum extent permitted by law, Visyfy, LLC shall not be liable for indirect, incidental, consequential, or special damages arising from program participation, including delivery failures or carrier charges.

Changes to These Terms

These Terms may be updated periodically. Material changes will be posted with an updated effective date. Continued participation constitutes acceptance of revisions.
